It is known to all that COVID-19 has affected nationally and globally the health of people and even the economy, in this sense commercial activities have been reduced affecting the economic capacity of each person, in view there is a group of people who have been affected to fulfill their obligations including the payment of leases whether housing or commercial there that the National Government issued the Decree May 1, 2020, which deals with leases, launch processes and evictions.
The purpose of this decree is to suspend the legal effects of Executive Decree 294 of 7 December 1994 and Executive Decree No. 7 of 10 January 1995, in addition to the suspension during the State of Emergency of any process, launch or eviction of persons or businesses that have been affected in its economic capacity by COVID-19 regardless of the lease levy stipulated , including the freezing of lease payments as well as their increases, the penalty for unilateral termination of the contract or late payment until a period of 2 months after the suspension of the State of Emergency.
The decree also states that the lessee may agree with the lessor the payment of those leases that have not been paid during the period of the State of Emergency by granting for this purpose a period of up to 2 years, in turn states that if the lessee is not of those persons who could be affected by COVID-19 and decides not to fulfil its obligations to the landlord the same may be sanctioned by the Leasing Directorate , the decree also states that the lessor may not exert any pressure on the payment of leases in the sense of cutting off water, electricity, gas services.
